Our students ought to know about the history of formal hospital segregation and desegregation. To that end, this article urges those who teach foundational health law and policy courses to do three things. First, to teach the Simkins case. Second, to swap out the usual Medicare signing ceremony picture for one that includes W. Montague Cobb, M.D., Ph.D. Third, to highlight how the implementation of that program for the elderly led, in a matter of months, to the desegregation of hospitals (...) throughout the country. Between 2010 and 2016, the percentage of uninsured higher education students dropped by more than half. All the Affordable Care Act's key access provisions contributed, but the most important factor appears to be the Medicaid expansion. This article is the first to highlight this phenomenon and ground it in data. It explores the reasons for this dramatic expansion of coverage, links it to theoretical frameworks, and considers its implications for the future of health reform. Drawing on Medicaid universality scholarship, I (...) discuss potential consequences of including the educationally privileged in this historically stigmatized program. Extending this scholarship, I argue that the student experience and its reverberating effects portend support for emerging proposals to make Medicare a more common option. Woven into both analyses is the role of the Trump-era retrenchment, notably the administration's promotion of Medicaid “work or community engagement” requirements and of cheap, skimpy plans. Higher education students were an afterthought in the ACA's debates, and yet the law has profoundly impacted their coverage options. Students are now much more likely to have health insurance, and for it to be comprehensive. Looking to the next decade, the student experience harbingers support for both Medicaid universality and Medicare commonality. (shrink)

Immanuel Kant's Groundwork of the Metaphysics of Morals of 1785 is one of the most profound and important works in the history of practical philosophy. In this introduction to the Groundwork, Sally Sedgwick provides a guide to Kant's text that follows the course of his discussion virtually paragraph by paragraph. Her aim is to convey Kant's ideas and arguments as clearly and simply as possible, without getting lost in scholarly controversies. This paper provides an account of social practices that reveals how they are constitutive of social agency, enable coordination around things of value, and are a site for social intervention. The social world, on this account, does not begin when psychologically sophisticated individuals interact to share knowledge or make plans. Instead, culture shapes agents to interpret and respond both to each other and the physical world around us. Practices shape us as we shape them. I revise J L Mackie's first account of casual direction by replacing his notion of "fixity" by a newly defined notion of "sufficing" that is designed to accommodate indeterminism. Keeping Mackie's distinction between casual order and casual direction, I then consider another revision that replaces "fixity" with "one-way conditionship". In response to the charge that all such accounts of casual priority beg the question by making an unjustified appeal to temporal priority, i maintain that one-way conditionship explains rather that assumes (...) objective temporal dependence as well as objective casual dependence. The hypothesis that we may be living in a digital simulation is utilized as a ‘thought experiment’ to help clarify important questions in theology and philosophy, including the nature of God, the significance and importance of an afterlife, and the ultimate nature of reality. It is argued that a consideration of the simulation hypothesis renders problematic traditional conceptions of a personal, creator, omnipotent deity, makes the theological significance of a purported afterlife far less significant, and paradoxically undermines the very materialistic (...) view of reality that underlies the simulation hypothesis in the first place. It is concluded that the simulation hypothesis renders ‘science’ virtually irrelevant to ultimate questions in philosophy and theology and elevates ethics and axiology to fundamental status for our understanding of reality and any defensible conception of the divine. Miranda Fricker's Epistemic Injustice is a wide-ranging and important book on a much-neglected topic: the injustice involved in cases in which distrust arises out of prejudice. Fricker has some important things to say about this sort of injustice: its nature, how it arises, what sustains it, and the unhappy outcomes associated with it for the victim and the society in which it takes place. In the course of developing this account, Fricker also develops an account of the epistemology of testimony. (...) Focusing my attention on that account, my central claims are two. First, at least some of Fricker's arguments against existing (inferentialist and non-inferentialist) views in the epistemology of testimony are less than fully persuasive, and the (non-inferentialist) view she ends up endorsing is not all that different from the views she criticizes. Second, her reasons for harboring doubts regarding the role of a principle of default entitlement within a non-inferentialist account are not persuasive. Neither of these claims affects the overall argument Fricker is trying to run. Rather, they suggest that Fricker may have picked more fights than she needed to in the epistemology of testimony. If so, we have reason to detach Fricker's important work on epistemic injustice from some of the details of the story she tells regarding the epistemology of testimony. (shrink)

It is always awkward when someone asks me informally what I’m working on and I answer that I’m trying to figure out what gender is. For outside a rather narrow segment of the academic world, the term ‘gender’ has come to function as the polite way to talk about the sexes. And one thing people feel pretty confident about is their knowledge of the difference between males and females. Males are those human beings with a range of familiar primary and (...) secondary sex characteristics, most important being the penis; females are those with a different set, most important being the vagina or, perhaps, the uterus. Enough said. Against this background, it isn’t clear what could be the point of an inquiry, especially a philosophical inquiry, into “what gender is”. (shrink)

This book is about the ethical issues arising in the course of business, especially those affecting people working in Asia. Each chapter offers a different perspective and the positions taken vary greatly from one writer to another.

Scholars and practitioners addressing the global food crisis have rarely incorporated perspectives from the world's religious traditions. This lacuna appears in multiple dimensions: until recently, environmentalists have tended to ignore food and agriculture; food justice advocates have focused on food quantities, rather than its method of production; and few scholars of religion have considered agriculture. Faith-based perspectives typically emphasize the dignity and sanctity of creation and offer holistic frameworks that integrate equity, economic, and environmental concerns, often called the three legs (...) of sustainability. Faith-based perspectives can provide new paradigms through which to assess food, consumption, and production and the attendant social relations; assess our scientific, economic, and social approaches; and acknowledge the moral and religious dimensions of the world food crisis. In this paper I argue, first, that the most influential (and perhaps only acceptable) account of the epistemology of self-knowledge, developed and defended at great length in Wright (1989b) and (1989c) (among other places), leaves unanswered a question about the psychology of self-knowledge; second, that without an answer to this question about the psychology of self-knowledge, the epistemic account cannot be considered acceptable; and third, that neither Wright's own answer, nor an interpretation-based answer (based on a proposal from Jacobsen (1997)), (...) will suffice as an acceptable answer to the psychological question. My general ambition is thus to establish that more work is needed if we are to have a full account of self-knowledge in both its epistemological and psychological aspects. I conclude by suggesting how my thesis bears on those who aim to provide an empirical account of the cognition involved in self-knowledge. (shrink)

A philosophically useful account of social structure must accommodate the fact that social structures play an important role in structural explanation. But what is a structural explanation? How do structural explanations function in the social sciences? This paper offers a way of thinking about structural explanation and sketches an account of social structure that connects social structures with structural explanation.

We explore the view that Frege's puzzle is a source of straightforward counterexamples to Leibniz's law. Taking this seriously requires us to revise the classical logic of quantifiers and identity; we work out the options, in the context of higher-order logic. The logics we arrive at provide the resources for a straightforward semantics of attitude reports that is consistent with the Millian thesis that the meaning of a name is just the thing it stands for. We provide models to show (...) that some of these logics are non-degenerate. (shrink)

The authoranalyzes the types of metaphors that are used to describe the Internetin issues of Wired magazine from before and after the dot-com collapse to understand the perceptions and expectations of some of the actors involved in the shaping of the Internet. In addition, the metaphors deployed in economics and geophysiology are used to demonstrate how metaphors can influence public debate, policy, and theory. The author argues that metaphors do not simply have a descriptive function but that they also carry (...) normative connotations. Language, alongside social practices and material objects, is an important tool in attempts to construct the future. Six overlapping metaphorical themes are identified: revolution, evolution, salvation, progress, universalism, and the “American dream.” A critical analysis of these metaphors, informed by a critique of the metaphors used in economics and geophysiology, leads the author to challenge the universalist claims made by some Internet enthusiasts for the inclusive potential of the Internet. Racism, sexism, and other forms of injustice are more than just bad attitudes; after all, such injustice involves unfair distributions of goods and resources. But attitudes play a role. How central is that role? Tommie Shelby, among others, argues that racism is an ideology and takes a cognitivist approach suggesting that ideologies consist in false beliefs that arise out of and serve pernicious social conditions. In this paper I argue that racism is better understood as a set of practices, attitudes, (...) social meanings, and material conditions, that systematically reinforce one another. Attitudes play a role, but even the cognitive/affective component of ideologies should include culturally shared habits of mind and action. These habits of mind distort, obscure, and occlude important facts about subordinated groups and result in a failure to recognize their interests. How do we disrupt such practices to achieve greater justice? I argue that this is sometimes, but not always, best achieved by argument or challenging false beliefs, so social movements legitimately seek other means. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:Sanford Freedman CHARACTER IN A COHERENT FICTION: ON PUTTING KING LEAR BACK TOGETHER AGAIN Criticism has never been able to talk about fictionality very long without talking about an "inside" and an "outside," a fictional world's relation to a non-fictional world. And always there lies an immediate tension in this relation posed by the concept of coherence. That is, does a fictional world cohere because it corresponds to (...) meanings "outside" die text or does a fictional world cohere because its "inside" parts stand in meaningful relation to each other? Northrop Frye, in explicating his dieory of symbols, distinguishes between "inside" and "outside" critical directions: Whenever we read anything, we find our attention moving in two directions at once. One direction is outward or centrifugal, in which we keep going outside our reading, from the individual words to the things they mean, or, in practice, to our memory of the conventional association between them. The other direction is inward or centripetal, in which we try to develop from the words a sense of the larger verbal pattern they make.1 That Frye suggests that critics see in both directions at once separates him from most twentieth-century Shakespearean critics who exaggerate one direction at the expense of the other. In this essay I will examine criticism of King Lear, specifically criticism about the play's characters from the eighteenth, nineteenth, and twentieth centuries, as a way of assessing this distinction, focusing on two related problems: first, how the eighteenth and nineteenth centuries' legacy of"inside"/"outside" talk affects twentieth-century critical debate, and second, how twentieth-century controversy polarizes "insides" and "outsides" without acknowledging the implications of doing so. If such an exaimination serves to undermine dominant twentieth-century concepts of coherence within Shakespearean criticism by pointing to unwritten rules-of-thumb, it does so, ultimately, to alter perspective on the supposed rites of passage from theories which give us cleair, alternative versions of a fictional world (traditional theories) to theories which seem to leave us floundering in a pluralist acceptance of all possible versions of a fictional world (deconstructive theories). 196 Sanford Freedman197 Eighteenth-century critics do not scrutinize King Lear from the point of view of character but rather through the mental images or ideas which the characters' words evoke. When Johnson faults Shakespeare's description of Dover Cliff in IV.vi, he argues diat the passage "does not impress die mind at once with the horrible idea of an immense height. The impression is divided; you pass on, by computation, from one stage of the tremendous space to another."2 Lifting Edgar's words out of die context of character, Johnson assumes the role of the purveyor of literature, akin to the role Pope assumed when he starred the "beauties" in his Shakespearean texts. What concernsJohnson is the "true" effect of looking down from a precipice, and he implies that the description should produce in different minds the same idea, an idea which is for him a singular idea, unmediated by composite ideas because the idea of looking down from a precipice necessitates that the immediacy of effect be synonymous with that of the idea. Edgar's purpose in leading his father to the cliffis overshadowed by the idea of looking down from a cliff, and we would do well to investigate an "outside" source, Locke's An Essay Concerning Human Understanding, rather than the Shakespearean text, as a means of discovering the purposefulness of Johnson's comment. Critical significance lies notjust inJohnson's airing ofneoclassical concern, but, more importantly, in his failure to find what he expects to be "there" in the play's "inside." Ideas, not characters, matter to the eighteenth-century's coherence, and the scope or comprehensiveness of that coherence has relatively local application; that is, editors range over several lines looking for relevant ideas but not between scenes or acts. In fact, one explanation of why they do not see a double plot is that their critical attention, like that of Swift's Lilliputians, lacks scope; dierefore, they fail to anticipate, to see patterns. This book is a study of the philosophy of arithmetic in one of the most significant periods of its history—from Frege to Carnap—prefaced by an account of Kant. Potter aims at a philosophical history, a story told from an explicit interpretative perspective. These theories of arithmetic are seen as attempts to account for its “source of content” and “source of concepts.” Potter never explains these terms; I take the former to be the thing that, when we have knowledge of it (...) or insight into it, provides the ultimate justification for pure and applied arithmetical discourse. That is, Potter’s principal concern is both ontological and epistemological: what determines, and how do we know, the truth of the statements that express our putative arithmetical knowledge? The criterion of success of a theory of arithmetic is how well it explains arithmetic’s simultaneous necessity or apriority and empirical applicability. Potter divides the theories he discusses into four main types, determined by their accounts of the “source of content” and “concepts”: sensibility, thought, language, and the world. At the end, Potter finds that none succeeds in accounting for all of arithmetic: at best some capture the infinity of the natural numbers, but none gives the “source” of arithmetical concepts. But the “similarities … between the scopes of the various approaches” suggest a Gödelian moral for Potter’s tale: the philosophy of arithmetic must treat concepts of “thought structures or … contents,” where “reflection upon the meanings” of “propositions about these mental objects” is needed for their proofs. Across the humanities and social sciences it has become commonplace for scholars to argue that categories once assumed to be “natural” are in fact “social” or, in the familiar lingo, “socially constructed”. Two common examples of such categories are race and gender, but there many others. One interpretation of this claim is that although it is typically thought that what unifies the instances of such categories is some set of natural or physical properties, instead their unity rests on social features (...) of the items in question. Social constructionists pursuing this strategy—and it is these social constructionists I will be focusing on in this paper—aim to “debunk” the ordinary assumption that the categories are natural, by revealing the more accurate social basis of the classification.2 To avoid confusion, and to resist some of the associations with the term ‘social construction’, I will sometimes use the term ‘socially founded’ for the categories that this sort of constructionist reveals as social rather than natural. Recent work on social injustice has focused on implicit bias as an important factor in explaining persistent injustice in spite of achievements on civil rights. In this paper, I argue that because of its individualism, implicit bias explanation, taken alone, is inadequate to explain ongoing injustice; and, more importantly, it fails to call attention to what is morally at stake. An adequate account of how implicit bias functions must situate it within a broader theory of social structures and structural injustice; (...) changing structures is often a precondition for changing patterns of thought and action and is certainly required for durable change.
